1 Florida Mia Marcano, who went missing from her Florida apartment and was later found dead in a wooded area, has filed a false death lawsuit against her apartment complex and the company that operates it.
According to CNN, the lawsuit filed earlier this week alleges negligence in companies owned and operated by Arden Villas Luxury Apartments in Orlando, where Mia lived and worked. The lawsuit claims more than 30,000 in damages, excluding interest, costs and attorneys’ fees.
The lawsuit also alleges the battery of Armando Manuel Caballero, a maintenance worker at the Arden Villas apartment, and the main suspect in Mia’s death, who took his own life after his disappearance, investigators said.
Mia went missing on September 2 after failing to board a flight bus, and her body was found on October 2 in a forest near an apartment complex where Caballero once lived. According to officials, Mia’s hands and feet were tied and her face was covered with tape.
Orange County Sheriff John Mina had previously said investigators “generally believe Armando Caballero was responsible for Mima’s death” and named Caballero’s estate as a defendant in the case.
Authorities said they believe Caballero, who was found dead on Sept. 27, entered Mia’s apartment without his permission.
“We now know that the maintenance-issued Master Key Phob, which was reportedly in Caballero’s possession, was used for a walk to Mia’s apartment around 4:30 pm on Friday. It would have been about 30 minutes before he finished his shift in the apartment complex, ”Mina said earlier.
The family wants to blame the apartment complex.
“Arden Villas gave Armando Caballero free access to kill Mia. They must be held accountable for their negligence,” family lawyer Daryl K. Washington said in a news release.
Mia was uncomfortable because Caballero was interested in her and her family felt the apartment did not take her concerns seriously, the lawsuit said.
“Marcano expressed his concern to Arden Villas employees as well as his parents who were concerned that … Arden Villas’ manager is not taking the safety of employees and tenants very seriously,” the lawsuit states.

According to the filing, the case demands trial by a jury.
